Assuming my dad is a citizen. Also assume that I am over 21 and have been out of status from H1B visa for more than 6 months, Is there any hope of gaining legal status aside from marrying a US citizen?Can a citizen parent legalize out of status child?
Your big problem is the ';out of status'; thing. If you were in status he could petition you though I think it's a long wait, but out of status -- no, you're not eligible and should leave ASAP so that you will regain eligibility. If you get caught and deported you could get 10 years ban.
