Can one parent's sexuality be a major factor in a custody battle?

Okay, so here's the situation: a couple has been divorced for almost two years and the father has full custody of their two-year old son. If the father was gay or if openly gay people (for example, a cross-dresser or a club performer) had close contact with the kid because of the father's allowance, is that a strong reason that the mother can win full custody?Can one parent's sexuality be a major factor in a custody battle?
All things are taken into consideration at custody hearings..the judge makes the final decisions. Usually custody battles are ugly, intense, and sexuality issues can increase the issues by the other party, be prepared for a fight in court.Can one parent's sexuality be a major factor in a custody battle?
if you live in the 19th centuary then yes.......the mother in my opinion is going to need a better fight than that. A gay father can be a better father than anyone......sexuality has NOTHING to do with it. What does sexuality matter? at the end of the day it is what is going to be best for the kid, gay or not
Probably not. My ex son in law is a full fledged alcoholic (along with his family) and he has my grandkids most of the time. When my daughter tried to bring it up during the divorce proceedings, she was told it didn't matter.





Can I tell you what the future holds for my grandkids? It's not good and it breaks my heart and there is NOTHING I can do. Same thing probably to you. It's very sad.....
Sadly, I doubt it'll be considered unless you have an awesome judge. Can you imagine the consequence of a law official admitting that the homosexual lifestyle is harmful (despite the obviousness of it)? That being said, the mother should fight it with all she's got!
if he has no charges he can still have some custody. the mother can have most of the custody. but that gay stuff will defeinetly hacve an impat on the judges deciasion. he most likely will still have some rights to see his child. sorry
It can really depend. Like if you're in a more conservative part of the country, it might make a bigger difference. In California, for example, it might make less of a difference.
